Do not let a DUI affect your life

Are you facing a DUI conviction? James E. Cox can help. As a DUI attorney, he fights for you to get the results you want and need. The following are DUI definitions you need to know when facing a conviction.

"Per se" blood alcohol concentration (BAC):

As of August 2005, all states have DUI laws that consider per se intoxicated as at or above .08 percent. This means that drivers with a BAC at or above .08 percent are intoxicated in the eyes of the law, and no additional proof of driving impairment is necessary.

"Zero tolerance" blood alcohol concentration:

All states carry zero tolerance laws that target drivers under the legal drinking age. These laws penalize persons under 21 for operating a vehicle with any trace of alcohol in their systems or with negligible BAC levels.

"Enhanced penalty" blood alcohol concentration:

Many states impose harsher penalties on DUI offenders with a BAC of .15 percent and above. DUI offenders with a BAC at or above their state's enhanced penalty standards will likely face additional jail time, harsher fines and severe driver's license sanctions.

"Implied consent" laws:

Implied consent laws require vehicle drivers to submit to some form of chemical test, such as breath, blood or urine testing, if suspected of DUI. If a driver refuses, implied consent laws carry penalties such as mandatory license suspension.

Criminal laws and their sources:

Criminal statutes describe the type of conduct that has been deemed a crime, the mindset or intent required and in some instances, the proper punishment.

Section 459 burglary definitions:

Every person who enters any house, room, apartment, tenement, shop, warehouse, store, mill, barn, stable, outhouse or other property with intent to commit grand or petit larceny or any felony is guilty of burglary.

Section 461 burglary is punishable as follows:

Burglary in the first degree is punishable by imprisonment in the state prison for two, four or six years. Burglary in the second degree is punishable by imprisonment in county jail for up to one year or in state prison. People who are found to have violated a criminal law can be punished through imposition of fines, imprisonment, probation and community service, among other penalties.
